Four Decades for Justice
On August 2, 2010, the United States District Court for the Southern District of New York granted a motion to dismiss in favor of Cravath clients Time Inc. and Time Warner Retail Sales & Marketing, Inc., and several unaffiliated magazine publishers, national distributors and wholesalers, in connection with antitrust litigation filed by Anderson News LLC and Anderson Services, LLC (collectively, “Anderson”). Anderson, a defunct wholesaler of magazines, alleged in its complaint that in an attempt to monopolize the U.S. wholesale magazine distribution market, the defendants eliminated Anderson from the magazine industry and destroyed its business. The Court dismissed Anderson’s lawsuit with prejudice, holding that the complaint’s allegations were insufficient to raise any inference of conspiracy among the defendants.
