An article by Cravath partner Benjamin Gruenstein and associate Jeffrey J. Izant, entitled “Newman Addresses Divisive Insider Trading Question,” appeared in the July 7, 2014, issue of the New York Law Journal as part of its White-Collar Crime Special Report. The article examines the pending Second Circuit appeal in U.S. v. Newman, et al., which hinges on whether a “tippee” in an insider trading case, in order to be found guilty, must be aware that the tipper received a benefit in exchange for disclosing non-public information, an issue that has divided lower courts.
