An article authored by Cravath partner David J. Kappos, entitled “High Court Must Shift Focus in Reviewing Software Patents,” was published on March 24, 2014 in the Appellate, Intellectual Property and Technology sections of Law360. The piece, which discusses the U.S. Supreme Court case Alice Corp v CLS Bank, proposes a new approach to evaluating patent claims that would focus on clear descriptions and reasonably scoped claims, with less emphasis on the question of whether patent claims are drawn to statutory subject matter.
