David Greenwald is a partner in Cravath’s Litigation Department. He practices general commercial litigation, with concentrations on patent litigation (particularly concerning chemical, pharmaceutical and biotechnological patents), and white collar criminal defense.
Mr. Greenwald’s representative matters have included:
- Representation of various pharmaceutical companies in actions seeking to enjoin generic drug entry prior to patent expiration;
- Defense of one of the largest Swiss banks in a civil action seeking disclosure of thousands of accountholder names in violation of Swiss financial privacy laws;
- Representation of a major biotechnology company in an action asserting infringement of a patent claiming improved methods for expressing proteins in mammalian cells;
- Representation of a major consulting firm in connection with criminal and SEC insider trading investigations and prosecutions;
- Representation of a drug company in an action to enforce a patent claiming methods of inhibiting NF-kB, a major cellular signaling molecule;
- Representation of various European financial institutions, including a major Madoff “feeder fund,” against “clawback” actions by the Trustee of the Bernard L. Madoff Investment Securities SIPA Liquidation;
- Representation of a Swiss bank in connection with a Department of Justice criminal tax investigation;
- Defense of a chemical company against claims of patent infringement relating to fluoropolymer emulsification technology;
- Defense of a major biotechnology company in a licensing dispute;
- Defense of a major wireless technology company against claims of patent infringement relating to methods of downconverting cellular telephone signals; and
- Representation of a broker-dealer in a FINRA enforcement action.
Mr. Greenwald was born in New York, New York. In 1990, he received a B.A. summa cum laude (biochemical sciences) from Harvard College, where he was elected to Phi Beta Kappa. In 1993, Mr. Greenwald received a J.D. with high honors from the University of Chicago, where he was an Editor of the Law Review and the recipient of the D. Francis Bustin Prize and was elected to the Order of the Coif.
Following a clerkship with Hon. Richard A. Posner (Chief Judge, U.S. Court of Appeals for the Seventh Circuit), Mr. Greenwald joined Cravath in 1994. In 1997, he left to join the U.S. Attorney’s Office, Southern District of New York, Criminal Division, where he served as an Assistant U.S. Attorney and successfully represented the government in trials and appeals. In 2000, he returned to Cravath. At Cravath, Mr. Greenwald oversees the Litigation Department’s Continuing Legal Education program.
