Cravath partner Benjamin Gruenstein authored an article on the implications of the recent U.S. v. Martoma decision for the “personal benefit” requirement in insider trading cases, which was published in the New York Law Journal on July 24, 2019. The article summarizes the evolution of that key requirement from its inception through today, and examines what this most recent shift might mean for future criminal prosecutions.
