Cravath partner David J. Kappos authored an article entitled “National Security Consequences of U.S. Patent (In)eligibility,” which was published by Morning Consult on November 4, 2019. The article discusses the effect of decisions by U.S. courts declaring broad swathes of new technologies, including in the key areas of artificial intelligence, quantum computing and 5G, ineligible for patent protection. Dave concludes that reforms to the patent approval process will be necessary to drive innovation in those technologies.
