David Greenwald

Partner, Litigation

David Greenwald focuses his practice on patent litigation (particularly concerning chemical, pharmaceutical, and biotechnological patents) and white collar criminal defense.

Mr. Greenwald’s significant recent representative matters have included:

  • Representation in patent litigation under the BPCIA of the first biological drug company to obtain approval to market a biosimilar of Humira®, the world’s largest selling drug;
  • Representation at trial of a major pharmaceutical company in Hatch‑Waxman Act actions to enjoin approval of generic versions of posaconazole, a drug indicated for prevention of life‑threatening fungal infections;
  • Representation at trial of a major biological drug company in a patent infringement action involving patents covering PCSK9 inhibitors, therapeutic antibodies indicated for the reduction of LDL‑cholesterol;
  • Representation at trial of a pharmaceutical company in a Hatch‑Waxman action to enforce patents covering formulations of formoterol, a drug indicated for the treatment of chronic obstructive pulmonary disease;
  • Representation of a biopharmaceutical company in a patent licensing dispute with a medical research center, involving rights to CAR-T cancer therapy technology;
  • Representation of a pharmaceutical company in an appeal from an adverse judgment enjoining generic entry of efavirenz, a drug indicated for the treatment of AIDS;
  • Representations of Swiss banks in criminal investigations conducted by the Department of Justice, and advice to others not under criminal investigation.

Mr. Greenwald was born in New York, New York. In 1990, he received a B.A. summa cum laude (biochemical sciences) from Harvard College, where he was elected to Phi Beta Kappa. In 1993, Mr. Greenwald received a J.D. with high honors from the University of Chicago, where he was an editor of the Law Review and the recipient of the D. Francis Bustin Prize and was elected to the Order of the Coif. After graduation, Mr. Greenwald served as a law clerk to Hon. Richard A. Posner of the U.S. Court of Appeals for the Seventh Circuit.

Mr. Greenwald joined Cravath in 1994. In 1997, he left to join the U.S. Attorney’s Office, Southern District of New York, Criminal Division, where he served as an Assistant U.S. Attorney and successfully represented the government in trials and appeals. He rejoined Cravath in 2000 and was elected a partner in 2004. 

Mr. Greenwald is a patent attorney registered with the United States Patent and Trademark Office.
