Lauren Roberta Kennedy

Lauren R. Kennedy focuses her practice on complex civil litigation related to antitrust, intellectual property, environmental, securities and contractual disputes. Ms. Kennedy has represented a wide range of clients, including American Express, Blue Cross and Blue Shield of Alabama, Blue Cross and Blue Shield of Florida, Blue Cross Blue Shield of Massachusetts, Inc., BlueCross BlueShield of Tennessee, Mylan, NCR, Novartis and Spirit AeroSystems. Ms. Kennedy has significant trial experience; she has tried six cases in federal and state courts in the past seven years.

Some of her recent representative matters include:

  • Representing Blue Cross and Blue Shield of Alabama, Blue Cross and Blue Shield of Florida, Inc. (Florida Blue), Blue Cross Blue Shield of Massachusetts, Inc., and BlueCross BlueShield of Tennessee, Inc. in consolidated multidistrict antitrust class action litigation—one of the largest class actions in the country—alleging that the Blue Cross Blue Shield Association and its member plans have used the Association’s agreements to fix prices and limit competition.
  • Representing Florida Blue in antitrust litigation filed in Florida federal court alleging that Florida Blue’s exclusive agency relationships violate the Sherman Act and related state laws.
  • Representing GreenSky, Inc. and its officers and directors in putative class action securities litigation in New York federal and state courts alleging disclosure deficiencies in connection with GreenSky’s initial public offering.
  • Represented American Express in a lawsuit in the U.S. District Court for the Eastern District of New York brought by the Department of Justice and 17 state attorneys general alleging that certain provisions in AmEx’s merchant agreements violate the antitrust laws. The case culminated in a seven‑week bench trial in July‑August 2014, which was followed by successful appeals in favor of AmEx in both the Second Circuit and the Supreme Court.
  • Represented and won summary judgment for Spirit AeroSystems, in a breach of contract lawsuit filed in Delaware Superior Court by The Boeing Company, seeking nearly $150 million in indemnification from Spirit for damages and expenses that Boeing incurred as a result of two proceedings initiated by former Boeing employees.
  • Represented Novartis in a civil enforcement action brought by the U.S. Attorney’s Office for the Southern District of New York alleging violations of the False Claims Act and Anti‑Kickback Statute.
  • Represented and won summary judgment before the New York Court of Appeals for a professional services firm in October 2015, in an action brought by Nomura Asset Capital Corporation in connection with a commercial mortgage‑backed securitization.
  • Represented Mylan in a pharmaceutical patent infringement case in the U.S. District Court for the Northern District of West Virginia against Teva. Secured a trial victory after a seven‑day bench trial on the validity of the patents‑in‑suit in July‑August 2013.
  • Represented NCR Corporation in several environmental actions brought under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), relating to the environmental remediation of Wisconsin’s Fox River and Michigan’s Kalamazoo River, which were tried in February 2012 and February 2013.
  • Represented an Italian television manufacturer at trial in an action in Delaware Chancery Court against Royal Philips Electronics N.V. alleging breach of contract, fraud and other claims.
  • Represented an MTA supervisor pro bono at a jury trial against the New York City Transit Authority in the U.S. District Court for the Eastern District of New York alleging retaliation for reporting a hazardous safety condition in the New York City subway system.
  • Represented Chemed Corporation and various individual defendants in consolidated shareholder derivative litigation in Delaware federal court arising from alleged improper billing of Medicare and Medicaid.

In 2017, Ms. Kennedy co‑authored the U.S. chapter in the first edition of The Class Action Law Review. From 2016 to 2018, she co‑authored a chapter in the book The Dispute Resolution Review, published annually.

Ms. Kennedy was born in Mt. Kisco, New York. She received a B.A. degree summa cum laude in English from Georgetown University in 2007, where she was elected to Phi Beta Kappa, and a J.D. from Columbia Law School in 2010, where she was a Kent and Stone Scholar. Following her graduation, she served as a law clerk to Hon. Robert S. Smith of the New York Court of Appeals.

Ms. Kennedy joined Cravath in 2012 and was elected a partner in 2018.
