Cravath Financial Institutions Insights: Future of Banking

On September 8, 2021, Cravath published the inaugural edition of its Cravath Financial Institutions Insights newsletter, entitled “Future of Banking: Key Policy Making On the Horizon,” which summarized key financial regulatory policy developments from the summer which will be critical for the integration of innovation and technology into the banking sector. This edition anticipates a policy process that concludes with more regulation of nonbank actors and clarity about banks’ engagement with digital assets, with the President’s Working Group on Financial Markets, Federal Reserve Board, Basel Committee on Banking Supervision, SEC and other institutions publicly announcing their consideration of digital asset issues. The newsletter identifies steps to watch for over the coming months and concludes that the degree of interagency coordination will be particularly key.
