Cravath Partners Featured as Litigators of the Week by Global Competition Review for AmEx Win in DOJ Antitrust Suit

On October 3, 2016, Cravath partners Evan R. Chesler, Peter T. Barbur and Kevin J. Orsini were featured as “Litigators of the Week” by Global Competition Review for their successful representation of American Express Company in its winning appeal in the U.S. Court of Appeals for the Second Circuit of a trial decision in an antitrust lawsuit filed by the U.S. Department of Justice and 17 state attorneys general over merchant acceptance rules. The Second Circuit’s decision reversed the District Court’s determination that AmEx’s merchant acceptance rules violated federal antitrust law and remanded the case “with instructions to enter judgment in favor of Amex.” In its feature article, Global Competition Review noted that Evan, Peter and Kevin are highlighted for the “arguments—or the instincts—that beat the DOJ’s claim of a Sherman Act section 1 violation.”
