Cravath Partners Featured in Winner’s Playbook Article on AmEx Supreme Court Victory

On September 14, 2018, Cravath partners Evan R. Chesler, Peter T. Barbur and Kevin J. Orsini were featured in an article for Law360’s “Winner’s Playbook” series discussing the Firm’s representation of American Express in its long‑running antitrust dispute with the United States government over merchant acceptance rules. The article focuses on the Firm’s involvement in the case, and Evan, Peter and Kevin detail the trajectory of legal work beginning when the government filed its suit in 2010. They also discuss the strategic decision to focus the case on the perspective of the cardholders, in addition to the perspective of the merchants, leading to a June 2018 victory for AmEx at the U.S. Supreme Court.
