Dave Kappos Authors Article on Proposed Amendment to the Innovation and Competition Act for Law360

Cravath partner David J. Kappos and Paul Michel, retired Chief Judge of the U.S. Court of Appeals for the Federal Circuit, authored an article entitled “Federal Tech, Trade Bill Needs IP Owner Transparency Tweaks,” which was published by Law360 as an “Expert Analysis” on June 30, 2021. The article reviews a proposed amendment to the Innovation and Competition Act, legislation currently being considered in the U.S. Senate, which would create a novel and mandatory register at the U.S. Patent and Trademark Office. The article discusses potential issues with the proposed amendment, such as leaving the system vulnerable to gaming by sophisticated parties and devaluing patents by blocking enhanced damages, and proposes solutions to those issues.
