Dave Kappos Authors Article on SEP Policy for Law360

Cravath partner David J. Kappos and fellow former USPTO director Andrei Iancu authored an article entitled “SEP Draft Policy Imperils US Investment In Innovation,” which was published by Law360 as an “Expert Analysis” on April 6, 2022. The article reviews a recent draft policy statement on licensing standard essential patents (“SEPs”) and concludes that the draft policy, if implemented, could disincentivize innovation in vital standards-dependent industries, which would have a lasting impact on innovation and America's international competitiveness.
