Global Competition Review Honors Cravath with 2020 “Regional Firm of the Year ‐ Americas” and “Litigation of the Year ‐ Non‑Cartel Defence” Awards

On November 10, 2020, Global Competition Review (“GCR”) named Cravath the 2020 “Regional Firm of the Year ‐ Americas” for its successful representation of Qualcomm in multiple antitrust cases, including its appeal against the Federal Trade Commission, and Sabre in a successful appeal against an adverse jury verdict in a suit brought by US Airways.

The Firm’s representation of Qualcomm in its settlement with Apple was also recognized as “Litigation of the Year ‐ Non‑Cartel Defence.”

The GCR Awards recognize landmark matters demonstrating strategic and innovative work by teams of in‑house and external lawyers and economists, based on a vote of GCR readers.

Qualcomm Wins on Appeal Against FTC in Antitrust Suit

On August 11, 2020, the United States Court of Appeals for the Ninth Circuit ruled in favor of Cravath client Qualcomm Incorporated, a leading innovator of cellular technology, in its appeal from an adverse California federal court decision in an antitrust lawsuit filed by the Federal Trade Commission (“FTC”). In a complete defense victory for Qualcomm, the three‑judge panel for the Ninth Circuit unanimously reversed the district court’s judgment and vacated a permanent, worldwide injunction that prohibited several of Qualcomm’s core business practices.

Sabre Wins Appeal Vacating Jury Verdict in Antitrust Suit

On September 11, 2019, the U.S. Court of Appeals for the Second Circuit ruled in favor of Cravath client Sabre Holdings Corporation (“Sabre”) in an antitrust suit brought by US Airways. Citing the U.S. Supreme Court’s 2018 decision in Ohio v. American Express, which Cravath successfully litigated, the Second Circuit vacated a jury verdict against Sabre that had awarded $15 million in damages to US Airways, and remanded for a new trial.

Qualcomm and Apple Settle Worldwide Litigation and Enter into License Agreement and Chipset Supply Agreement

On April 16, 2019, Cravath client Qualcomm announced an agreement with Apple to dismiss all litigation between the two companies worldwide, with a settlement that includes a payment from Apple to Qualcomm. The companies also reached a global six‑year license agreement, effective as of April 1, 2019, including a two‑year option to extend, and a multiyear chipset supply agreement.
