Brittany L. Sukiennik focuses her practice on complex litigation, including mass torts and other commercial disputes. Her clients have included Biogen, Costamare, Crown Castle, Deloitte & Touche, FleetCor Technologies, Grupo Modelo, Light & Wonder, Merck, NCR, PG&E, Qualcomm and Robinhood.

Ms. Sukiennik’s current and recent matters include:

  • Representing PG&E in connection with mass tort litigation related to the California wildfires between 2019 and 2021. She previously represented the company in numerous lawsuits arising out of the unprecedented 2017 and 2018 California wildfires—one of the largest and most complex sets of mass tort litigation in recent years. She also represented PG&E in its chapter 11 reorganization proceedings—the largest utility bankruptcy in U.S. history—which the company successfully emerged from in 2020.
  • Representing Light & Wonder (formerly Scientific Games Corporation) in putative class action and individual antitrust litigation filed in Illinois federal court, and in an arbitration before the American Arbitration Association, involving Walker Process antitrust monopolization claims that concern automatic card shufflers used in casinos. 
  • Representing Xcel Energy, a major U.S. electricity and natural gas company with operations in eight states, in hundreds of lawsuits filed against Xcel arising from the December 2021 Marshall Wildfire. Ms. Sukiennik also represents Xcel and its subsidiary, Southwestern Public Service Company, in more than a dozen actions concerning the February 2024 Texas Panhandle wildfires, which included the Smokehouse Creek Fire.
  • Represented Robinhood in dozens of lawsuits, centralized in Florida federal court, including numerous putative class actions—securing a string of victories over more than three years to dismiss or otherwise resolve all claims against the company. The actions involved antitrust, contract, securities and various other state and federal claims arising out of Robinhood’s decision to temporarily place certain limits on trading in certain securities in the face of unprecedented market volatility. Ms. Sukiennik secured decisions dismissing all antitrust and state law claims filed against Robinhood, both of which were affirmed on appeal, and obtained a major ruling defeating class certification of the securities claims.
  • Represented Robinhood and certain of its senior executives and directors in winning back‑to‑back dismissals to defeat purported class action securities litigation concerning the company’s July 2021 IPO. Ms. Sukiennik continues to represent Robinhood on appeal and in a related stockholder derivative action.
  • Represented Costamare Shipping and related entities in connection with litigation filed in California federal court, including a consolidated putative class action, alleging various theories of liability concerning the October 2021 San Pedro Bay pipeline leak off the coast of California, ultimately securing a series of settlements to resolve the actions.
  • Represented Biogen in a qui tam action alleging that Biogen caused the submission of false claims to multiple federal healthcare programs through purported kickback schemes related to certain of Biogen’s multiple sclerosis drugs, which settled.
  • Represented Crown Castle in a putative securities class action litigation and related stockholder derivative litigation alleging that Crown Castle made false and misleading statements regarding revenue from its cell tower installation services.
  • Represented NCR in environmental litigation brought under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), relating to the environmental remediation of Wisconsin’s Fox River, including a trial in Wisconsin federal court.
  • Represented Merck in patent infringement litigation against Actavis Laboratories concerning the validity of Merck’s compound patent for Noxafil® (posaconazole), a leading antifungal medication. She was a member of the trial team that won a ruling in 2017 upholding the validity of Merck’s patent on the drug’s active ingredient following an eight‑day bench trial.
  • Represented Deloitte & Touche in a consolidated securities class action lawsuit in New York federal court arising out of the collapse of Bear Stearns and its acquisition by JPMorgan Chase in 2008. She also represented Deloitte in individual opt‑out securities actions brought by Bear Stearns shareholders, including an action brought by SRM Global Master Fund that alleged over $200 million in damages.
  • Defended Qualcomm in an antitrust action, which alleged it conspired with AT&T and Motorola to impede plaintiffs’ ability to offer 4G LTE services that would compete with AT&T’s services. The case was dismissed with prejudice.
  • Represented FleetCor Technologies, a payment service provider, and its subsidiary as trial counsel in a breach of contract dispute filed in the Delaware Court of Chancery by TA Operating, an operator of nationwide travel centers. The matter was tried in 2017.
  • Advised Grupo Modelo on antitrust issues in connection with its $20.1 billion acquisition by Anheuser‑Busch InBev.

Ms. Sukiennik also maintains an active pro bono practice. Recently, she secured a substantial monetary settlement on behalf of a woman who was sexually assaulted by NYC Department of Correction officers while detained on Rikers Island. In 2023, The Legal Aid Society honored Ms. Sukiennik and other members of the Cravath team with a Pro Bono Publico Award in recognition of their work for pro bono clients as part of Cravath’s Incarcerated Survivors Initiative.

Ms. Sukiennik is from Omaha, Nebraska. She received a B.A. summa cum laude from The University of Texas at Austin in 2007, where she was elected to Phi Beta Kappa. She received a J.D. from Columbia Law School in 2011, where she was a James Kent Scholar, was awarded the Ruth Bader Ginsburg Prize and served as the Senior Editor of the Law Review.

Ms. Sukiennik joined Cravath in 2011. In 2012, she left to serve as a law clerk to Hon. Cathy Seibel, followed by a clerkship to Hon. Vernon S. Broderick, both of the U.S. District Court for the Southern District of New York.

Ms. Sukiennik rejoined Cravath in 2014 and was elected a partner in 2020.

Brittany Sukiennik Speaks at the 2024 National Wildland Fire Conference

On April 27, 2024, Cravath partner Brittany L. Sukiennik participated in the National Wildland Fire Conference, which was co‑hosted by various entities in Monterey, CA. The event convened legal experts, policy makers, land managers, firefighters, foresters, scientists and insurers to discuss the challenges in dealing with the ever‑growing threat of wildfires. Brittany spoke on a panel entitled “Managing Complex Wildland Fire Cases - Effective Approaches through Proper Case Leadership, Management, and Organization. Challenges and Perspectives from the Bench and Bar.”

The Legal Aid Society Honors Cravath Lawyers with 2023 Pro Bono Publico Award

On October 30, 2023, The Legal Aid Society honored Cravath partners Antony L. Ryan, Lauren M. Rosenberg and Brittany L. Sukiennik, of counsel Rebecca J. Schindel and associates Chizoba D. Ukairo and Frances C. McDonald as 2023 Pro Bono Publico Award recipients for outstanding service to the organization and their clients. Each year, Legal Aid recognizes the work of volunteer lawyers, law firms, corporations and other professionals who volunteer their time and talent to provide exceptional legal services to low‑income New Yorkers.   • Represented Costamare Shipping and related entities in connection with litigation filed in California federal court, including a consolidated putative class action, alleging various theories of liability concerning the October 2021 San Pedro Bay pipeline leak off the coast of California, ultimately securing a series of settlements to resolve the actions.
  • Represented Biogen in a qui tam action alleging that Biogen caused the submission of false claims to multiple federal healthcare programs through purported kickback schemes related to certain of Biogen’s multiple sclerosis drugs, which settled.
  • Represented Crown Castle in a putative securities class action litigation and related stockholder derivative litigation alleging that Crown Castle made false and misleading statements regarding revenue from its cell tower installation services.
  • Represented NCR in environmental litigation brought under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), relating to the environmental remediation of Wisconsin’s Fox River, including a trial in Wisconsin federal court.
  • Represented Merck in patent infringement litigation against Actavis Laboratories concerning the validity of Merck’s compound patent for Noxafil® (posaconazole), a leading antifungal medication. She was a member of the trial team that won a ruling in 2017 upholding the validity of Merck’s patent on the drug’s active ingredient following an eight‑day bench trial.
  • Represented Deloitte & Touche in a consolidated securities class action lawsuit in New York federal court arising out of the collapse of Bear Stearns and its acquisition by JPMorgan Chase in 2008. She also represented Deloitte in individual opt‑out securities actions brought by Bear Stearns shareholders, including an action brought by SRM Global Master Fund that alleged over $200 million in damages.
  • Defended Qualcomm in an antitrust action, which alleged it conspired with AT&T and Motorola to impede plaintiffs’ ability to offer 4G LTE services that would compete with AT&T’s services. The case was dismissed with prejudice.
  • Represented FleetCor Technologies, a payment service provider, and its subsidiary as trial counsel in a breach of contract dispute filed in the Delaware Court of Chancery by TA Operating, an operator of nationwide travel centers. The matter was tried in 2017.
  • Advised Grupo Modelo on antitrust issues in connection with its $20.1 billion acquisition by Anheuser‑Busch InBev.

Ms. Sukiennik also maintains an active pro bono practice. Recently, she secured a substantial monetary settlement on behalf of a woman who was sexually assaulted by NYC Department of Correction officers while detained on Rikers Island. In 2023, The Legal Aid Society honored Ms. Sukiennik and other members of the Cravath team with a Pro Bono Publico Award in recognition of their work for pro bono clients as part of Cravath’s Incarcerated Survivors Initiative.

Ms. Sukiennik has been included in Lawdragon’s “500 Leading Litigators in America,” “500 Leading Global Antitrust & Competition Lawyers” and “500 X – The Next Generation” lists. In 2025, she was selected to serve as a member of Law360’s Trials Editorial Advisory Board. Ms. Sukiennik previously received the “Rising Star: Litigation” award at Euromoney Legal Media Group’s Americas Women in Business Law Awards, which distinguishes lawyers “whose stars are shining brightest as future leaders in their jurisdictions.” The Legal 500 US has recognized her for her work in general commercial litigation, and Benchmark Litigation has repeatedly recognized her as a “Future Star” and named her to its “40 & Under List,” which recognizes the “best and brightest litigators across the US and Canada.”

Ms. Sukiennik is from Omaha, Nebraska. She received a B.A. summa cum laude from The University of Texas at Austin in 2007, where she was elected to Phi Beta Kappa. She received a J.D. from Columbia Law School in 2011, where she was a James Kent Scholar, was awarded the Ruth Bader Ginsburg Prize and served as the Senior Editor of the Law Review.

Ms. Sukiennik joined Cravath in 2011. In 2012, she left to serve as a law clerk to Hon. Cathy Seibel, followed by a clerkship to Hon. Vernon S. Broderick, both of the U.S. District Court for the Southern District of New York.

Ms. Sukiennik rejoined Cravath in 2014 and was elected a partner in 2020.

Brittany Sukiennik Speaks at the 2024 National Wildland Fire Conference

On April 27, 2024, Cravath partner Brittany L. Sukiennik participated in the National Wildland Fire Conference, which was co‑hosted by various entities in Monterey, CA. The event convened legal experts, policy makers, land managers, firefighters, foresters, scientists and insurers to discuss the challenges in dealing with the ever‑growing threat of wildfires. Brittany spoke on a panel entitled “Managing Complex Wildland Fire Cases - Effective Approaches through Proper Case Leadership, Management, and Organization. Challenges and Perspectives from the Bench and Bar.”

The Legal Aid Society Honors Cravath Lawyers with 2023 Pro Bono Publico Award

On October 30, 2023, The Legal Aid Society honored Cravath partners Antony L. Ryan, Lauren M. Rosenberg and Brittany L. Sukiennik, of counsel Rebecca J. Schindel and associates Chizoba D. Ukairo and Frances C. McDonald as 2023 Pro Bono Publico Award recipients for outstanding service to the organization and their clients. Each year, Legal Aid recognizes the work of volunteer lawyers, law firms, corporations and other professionals who volunteer their time and talent to provide exceptional legal services to low‑income New Yorkers. Antony, Lauren, Brittany, Rebecca, Chizoba and Frances received the 2023 award in recognition of their work for pro bono clients, including Tania Rodas, as part of Cravath’s Incarcerated Survivors Initiative.
