Katherine A. DuBois focuses her practice on complex litigation, particularly in the areas of antitrust, general commercial and securities.  

Ms. DuBois’s representative matters include:

  • Representation of the Special Committee of the Board of Directors of Paramount in putative class action stockholder litigation in the Delaware Court of Chancery concerning Paramount’s $28 billion merger with Skydance. 
  • Representation of Epic Games, creator of the hugely popular game Fortnite, in a case filed against Samsung and Google alleging they conspired to circumvent the court’s injunction against Google in connection with Epic’s high‑profile antitrust action concerning Google’s alleged anticompetitive behavior in the distribution of mobile apps and the handling of in‑app payments.
  • Representation of Novartis Pharmaceuticals in a qui tam action in New York federal court alleging violations of the False Claims Act and Anti‑Kickback Statute.
  • Representation of the Blue Cross Blue Shield Association (“BCBSA”) and more than a dozen member plans in consolidated multidistrict antitrust class action litigation—one of the largest class actions in the country—brought by putative classes of healthcare providers and health insurance subscribers, and in related opt‑out litigation across the country brought by large self‑funded subscribers and providers.  
  • Representation of American Express (“Amex”) in class action antitrust litigation brought by merchants alleging that Amex and numerous other credit and charge card issuers conspired to shift certain costs of fraudulent charges from the card issuers to merchants by the implementation of standards replacing swipe cards with chip cards.
  • Representation of Tesla CEO and Board member Elon Musk in helping to win a complete trial victory, affirmed on appeal, to defeat a $13 billion stockholder derivative action in the Delaware Court of Chancery related to Tesla’s $2.1 billion acquisition of SolarCity Corporation.  
  • Representation of affiliates of Bacardi Limited in helping to resolve a multi‑jurisdictional dispute with rapper Shawn “Jay‑Z” Carter related to the value of cognac brand D’Ussé.  
  • Representation of Minerals Technologies in an action brought by the bankruptcy estate of Novinda Corporation, alleging fraud, breach of fiduciary duty and breach of contract.  A favorable decision was secured following a three-week arbitration.
  • Representation of oil company YPF in litigation brought by minority shareholders arising out of Argentina’s 2012 expropriation of a controlling stake in YPF.  
  • Representation of First Solar in a securities class action and related opt‑out litigation alleging that First Solar and several of its officers and executives concealed manufacturing issues with its solar modules.
  • Representation of Morgan Stanley in antitrust class action litigation alleging collusion among banks to block exchange trading of interest rate swaps.

Ms. DuBois was born in Port Jefferson, New York. She received an A.B. magna cum laude in Psychology from Georgetown University in 2015, and a J.D. cum laude from New York University School of Law in 2018. At NYU, she was a McKay Scholar, the Editor‑in‑Chief of the Journal of Legislation and Public Policy and a board member of the Mental Health Law and Justice Association.

Ms. DuBois joined Cravath as a summer associate in 2017, and rejoined the legal staff as an associate in 2018. She was named of counsel in 2025.
