Lillian S. Grossbard has a broad litigation practice, with a particular focus on antitrust, commercial disputes and other advisory matters. She has represented a wide range of clients, including American Express, Biogen, the Blue Cross Blue Shield Association and various member plans, Costamare, Credit Suisse and PG&E, among others.

Ms. Grossbard’s representative matters include:

Antitrust Litigation

  • Representing the Blue Cross Blue Shield Association (“BCBSA”) and more than a dozen member plans in consolidated multidistrict antitrust class action litigation—one of the largest class actions in the country—brought by putative classes of healthcare providers and health insurance subscribers alleging that the Association and its members have used the Association’s agreements to fix prices and limit competition. She also represents BCBSA and various member plans in related opt‑out litigation across the country brought by large self‑funded subscribers and providers.
  • Represented Biosense Webster (a Johnson & Johnson subsidiary) in antitrust litigation brought by competitor Innovative Health alleging monopolization and restraint of trade in the nationwide market for the sale of high‑density mapping and ultrasound catheters. Ms. Grossbard helped secure a summary judgment victory for Biosense.
  • Represented Time Warner in an antitrust lawsuit brought by the DOJ seeking to block the company’s $109 billion sale to AT&T, securing a victory in June 2018 following a six‑week trial.
  • Represented Anheuser‑Busch InBev (“ABI”) in winning the dismissal of a consumer antitrust suit filed in Oregon federal court challenging ABI’s $123 billion acquisition of SABMiller plc and the $12 billion divestiture of SABMiller’s U.S. and global Miller‑branded businesses to Molson Coors Brewing Company.
  • Represented American Express in a consumer class action litigation alleging that American Express had conspired with other credit card issuers to adopt arbitration clauses barring class actions in card member agreements, securing a victory following a five‑week bench trial.

  • Advised Stanley Black & Decker on antitrust issues in connection with its $1.95 billion acquisition of the tools business of Newell Brands Inc.
  • Advised Weyerhaeuser Company on antitrust issues in connection with the $2.2 billion sale of its Cellulose Fibers pulp mills to International Paper Company.
  • Advised Grupo Villar Mir on antitrust issues in connection with its merger with Globe Specialty Metals, Inc. with an enterprise value of approximately $3.1 billion.
