Rebecca J. Schindel focuses her practice on complex litigation, particularly in the areas of antitrust, general commercial and securities. She has represented a variety of clients, including American Express, the Blue Cross Blue Shield Association and several member plans, First Solar and Merck.

Ms. Schindel’s representative matters include:

  • Representing American Express (“Amex”) in an antitrust class action lawsuit in New York federal court brought by merchants alleging a conspiracy among Amex and other credit and charge card issuers to shift the costs of fraudulent charges from the issuers to merchants through the implementation of chip cards. 
  • Representing Amex in a putative class action antitrust lawsuit in New York federal court alleging that Amex’s “anti‑steering” rules inflated prices paid for goods and services sold by merchants across the country.
  • Represented the Blue Cross Blue Shield Association (“BCBS”) and several member plans in consolidated multidistrict antitrust class action litigation—one of the largest class actions in the country—alleging that the Association and its members have used the Association’s agreements to fix prices and limit competition.
  • Represented Florida Blue in winning the dismissal of antitrust litigation filed by competitor Oscar Insurance alleging that Florida Blue’s exclusive agency relationships violated the Sherman Act.
  • Represented First Solar in a securities class action in Arizona federal court and related derivative actions alleging that First Solar and several of its officers and executives misrepresented the company’s financial state, concealed material facts regarding defective solar modules and committed accounting violations, all to inflate First Solar’s stock price.
  • Represented Merck in a consolidated, multidistrict shareholder fraud class action and related ERISA litigation arising out of alleged misrepresentations and omissions relating to Merck’s sale of the pain medication Vioxx®, which settled.  

Ms. Schindel is from Pound Ridge, New York. She received a B.A. with honors in Public Policy from Stanford University in 2010 and a J.D. magna cum laude from Harvard Law School in 2016. At Harvard, she was a senior article editor of the Law & Policy Review, a line editor of the International Law Journal, a teaching assistant for Legal Research and Writing and a research assistant to Climenko Fellow Maggie Gardner.

Ms. Schindel joined Cravath as a summer associate in 2014 and 2015 and returned to join the legal staff in 2016. After serving as a law clerk to the Hon. Katherine Forrest of the U.S. District Court for the Southern District of New York and to the Hon. Karen Nelson Moore of the U.S. Court of Appeals for the Sixth Circuit, she rejoined Cravath as an associate in 2018. Ms. Schindel was named of counsel in 2023.

The Legal Aid Society Honors Cravath Lawyers with 2023 Pro Bono Publico Award

On October 30, 2023, The Legal Aid Society honored Cravath partners Antony L. Ryan, Lauren M. Rosenberg and Brittany L. Sukiennik, of counsel Rebecca J. Schindel and associates Chizoba D. Ukairo and Frances C. McDonald as 2023 Pro Bono Publico Award recipients for outstanding service to the organization and their clients. Each year, Legal Aid recognizes the work of volunteer lawyers, law firms, corporations and other professionals who volunteer their time and talent to provide exceptional legal services to low‑income New Yorkers. Antony, Lauren, Brittany, Rebecca, Chizoba and Frances received the 2023 award in recognition of their work for pro bono clients, including Tania Rodas, as part of Cravath’s Incarcerated Survivors Initiative.
