Zachary W. Jarrett has a broad litigation practice, focusing on antitrust and general commercial matters.

Mr. Jarrett’s representative matters include:

  • Representation of American Express (“Amex”) in class action litigation in New York federal court alleging that Amex’s non‑discrimination provisions inflated prices paid for goods and services sold by merchants across the country. Following a three‑week trial, the jury unanimously found that Amex’s non‑discrimination provisions do not unreasonably restrain trade.
  • Representation of Amex in a putative class action brought on behalf of more than 5,000 merchants in Rhode Island federal court challenging Amex’s anti‑steering rules as anticompetitive, and in arbitrating more than 1,200 similar claims brought by merchants in separate JAMS and AAA arbitrations.
  • Representation of Xcel Energy, a major U.S. electricity and natural gas company with operations in eight states, in hundreds of lawsuits filed against Xcel arising from the December 2021 Marshall Wildfire.
  • Representation of members of the special transaction committee of Viacom’s Board of Directors in helping to secure a favorable settlement shortly before a scheduled trial in consolidated putative class action litigation in the Delaware Court of Chancery concerning Viacom’s $30 billion merger with CBS Corporation.
  • Representation of Epic Games, creator of the hugely popular game Fortnite, in its high‑profile antitrust action against Apple alleging anticompetitive behavior in the distribution of mobile apps and the handling of in‑app payments.
  • Representation of the Boston Red Sox in litigation brought by daily fantasy sports contest participants relating to allegations involving electronic sign‑stealing, helping to secure the dismissal of a consolidated purported class action filed by DraftKings participants, which was affirmed by the Second Circuit.
  • Represented Alcon Laboratories in connection with more than 50 class actions centralized in Florida federal court alleging that Alcon’s unilateral pricing policies for contact lenses violated Section 1 of the Sherman Act and state antitrust and consumer protection/unfair competition laws. The parties reached a favorable settlement on the eve of trial.
  • Representation of Goldman Sachs in helping to secure the dismissal, affirmed on appeal, of breach of contract and fraud claims brought by a former client based on alleged breaches of obligations owed by Goldman Sachs in connection with the syndication of financing for a $3 billion acquisition.
  • Representation of AngloGold Ashanti in helping to secure a summary judgment victory in litigation alleging breach of contract, fraudulent inducement and violations of federal and state securities statutes in connection with the company’s sale of a gold mine in Colorado.

Mr. Jarrett was born in New Orleans, Louisiana. He received a B.A. in Political Science and Spanish from Vanderbilt University in 2012, and a J.D. with honors from The University of Texas School of Law in 2015. At Texas, he was an articles editor of the Law Review, a research assistant to Professor Patrick Woolley and elected to the Order of the Coif.

He then underwent Marine Corps training from 2017 to 2018. Mr. Jarrett commissioned as a Second Lieutenant, and was later promoted to Captain, in the U.S. Marine Corps Reserve. From 2018 to 2019, he served as a law clerk to Hon. Edith Brown Clement for the U.S. Court of Appeals for the Fifth Circuit.
