Environmental

Cravath has been active for several decades in complex and often high‑profile environmental cases and investigations arising both from civil and criminal investigations by federal and state regulatory agencies and from commercial transactions.

On the commercial side, recent cases have ranged from the international arbitration of environmental cleanup claims throughout the world, to contractual litigation stemming from environmental responsibilities in merger agreements between major participants in the chemical industry, to resolving allegations under federal securities laws by bondholders about the environmental liabilities and disclosure of a publicly traded landfill company. In these matters, the depth and breadth of Cravath’s corporate practice has also provided the Firm’s clients with a valuable resource. On the regulatory side, the Firm has been involved in proceedings such as defending corporations against allegations under Superfund and the Clean Water Act, resolving complex claims with industry‑wide ramifications under the Clean Air Act and advising on natural resource damage claims and a number of state law environmental cleanup programs.
