Practice Overview

General Commercial Litigation and Contractual Disputes

Cravath has a long and distinguished history representing and advising clients involved in a wide variety of general commercial disputes. For the past 14 years, Chambers USA: America’s Leading Lawyers for Business has ranked Cravath in the highest tier for general commercial litigation. Cravath was also nationally ranked as a first‑tier firm in this practice area by Benchmark Litigation (2008‑2019), The Legal 500 (2015‑2018) and the U.S. News & World Report‑Best Lawyers’ “Best Law Firms” survey (2011‑2019). Benchmark named Cravath “General Commercial Firm of the Year” in 2016 and 2017.

We regularly handle matters—for both plaintiffs and defendants—involving alleged breaches of contract and the ever‑evolving category of business torts, such as fraud, breach of fiduciary duty, tortious interference with contract, tortious interference with prospective business relations, employee “raiding” claims and unfair competition claims. Frequently such claims arise in the context of wider litigation, involving related claims under various antitrust, securities or intellectual property laws or the RICO or FCPA statutes.

Because Cravath litigators are trained across a broad array of legal areas, the same team can handle the general commercial claims and the claims in more specialized areas of the law, allowing us to use small teams and be more cost‑effective. Together with members of the Cravath Corporate Department, Cravath litigators also advise corporate clients on how to structure business arrangements and practices in order to avoid litigation.
