On May 2, 2023, Cravath partners Benjamin Gruenstein and Daniel J. Cerqueira and of counsel Benjamin G. Joseloff participated in the American Bar Association’s 2023 International Law Section Annual Conference, which was held from May 2‑4, 2023 in New York.
Ben Gruenstein spoke on a panel entitled “Deferred Prosecution Agreements and How Much Do They Shield Corporations and Executives from Litigation and Arbitration?,” which reviewed recent developments in DPAs in the U.S. and abroad, and the impact of DPAs and other resolutions of government investigation on collateral civil litigation. Dan spoke on a panel entitled “Sellers Beware! How To Protect Sellers in M&A Transactions from Buyers’ Avarice or Excessive Fear of Risk,” which addressed varied safeguards and best practices to empower and better protect sellers in M&A transactions. Ben Joseloff spoke on a panel entitled “From a New Regulatory Landscape to the Emerging Economic Environment – Sovereign Finance in Dealmaking,” which explored regulatory and business considerations for transactions involving state‑owned entities and sovereign wealth funds.
