Cravath’s Antitrust Practice Ranks as “Elite” in GCR 100

On December 10, 2021, Cravath’s antitrust practice was ranked among the “Elite” in Global Competition Review’s 2022 edition of GCR 100, a guide to the world’s leading competition law and economics practices. This is the tenth consecutive year the Firm has been ranked in the highest tier among New York Firms by GCR. The publication highlighted Cravath’s role advising on antitrust matters for Mylan in its $50 billion merger with Pfizer’s off‑patent and generic medicines business Upjohn, and Illumina in its $8 billion acquisition of Grail. The feature also noted Cravath’s work for Epic Games in its litigation against Apple and Google, and for both Meta and the Blue Cross Blue Shield Association in ongoing antitrust litigations.

Illumina’s $8 Billion Acquisition of GRAIL

On September 21, 2020, Illumina, Inc. (“Illumina”) and GRAIL announced they have entered into a definitive agreement under which Illumina will acquire GRAIL for cash and stock consideration of $8 billion. In addition, GRAIL shareholders will receive future payments representing a tiered single digit percentage of certain GRAIL-related revenues. GRAIL, a healthcare company focused on multi-cancer early detection, was founded by Illumina, a global leader in DNA sequencing and array-based technologies, in 2016 and spun out as a standalone company. Cravath is representing Illumina in connection with the transaction.

Appeal of Antitrust Suit Brought Against Florida Blue by Oscar Insurance is Voluntarily Dismissed

On February 19, 2021, Oscar Insurance Company voluntarily dismissed with prejudice the appeal of its lawsuit against Cravath clients Blue Cross and Blue Shield of Florida, Inc., Health Options Inc., and Florida Health Care Plan, Inc. (together, “Florida Blue”), which was pending before the U.S. Court of Appeals for the Eleventh Circuit after Florida Blue won its motion to dismiss the case before the U.S. District Court for the Middle District of Florida on September 20, 2019.
