Dave Marriott Named a 2023 Antitrust MVP by Law360

On October 6, 2023, Cravath partner David R. Marriott was featured as a 2023 Antitrust MVP by Law360, which highlighted his role helping Illumina secure an unprecedented trial win rejecting the FTC’s challenge to Illumina’s $8 billion acquisition of GRAIL, as well as his representation of Imperial Sugar Company in a U.S. Department of Justice lawsuit contesting the company's acquisition by U.S. Sugar. In the profile, Dave noted he’s proud that the victory for Illumina “is going to be beneficial for people worldwide as they screen for cancer,” which is reflective of his broader interest in antitrust cases: “they kind of reverberate beyond a particular matter and have effects, especially the ones that are consumer oriented, that have … a way of potentially really helping and matter in people's lives.”

On September 23, 2022, the U.S. District Court for the District of Delaware denied the U.S. Department of Justice’s request for an injunction blocking Louis Dreyfus Company LLC’s (“LDC”) sale of the assets and business of its subsidiary Imperial Sugar Company (“Imperial Sugar”) to U.S. Sugar. The District of Delaware’s decision in favor of the Defendants followed a four day trial in April 2022 and post-trial briefing submitted in May 2022.
