Ben Gruenstein and Rebecca Schindel Author Article for the Bulletin of The International Academy of Financial Crime Litigators

Cravath partner Benjamin Gruenstein and of counsel Rebecca J. Schindel authored an article for the inaugural issue of the Bulletin of The International Academy of Financial Crime Litigators, which published in June 2023.

The article, entitled “The Risks of ‘Too Much’ Entanglement with the Government When Conducting Internal Investigations,” discusses the U.S. Department of Justice’s emphasis on individual accountability in its corporate enforcement policy, the incentives this creates for companies to align themselves with the government during a criminal investigation and the constitutional, ethical and business concerns that may arise as a result of undue alignment between company counsel and the government.
